MINAB
Terms of Use
1. Agreement
These Terms of Use (“Terms”) are a contract between you and Sama Data Processing (دادهپردازی عصر ارتباطات سما), also known as Sama Labs (“we”, “us”), for the Minab school platform (“Minab” or the “Service”).
By creating an account, signing in, or using Minab on the web or in the iOS or Android apps, you agree to these Terms and to our Privacy Policy. If you use Minab on behalf of a school, you also confirm that you are authorized to bind that school.
If you do not agree, do not use Minab.
2. The service
Minab is software for schools. It may include live classes, attendance, homework, exams, report cards, messages, a library, a calendar, parent permissions, and related school tools. Features depend on the school’s plan and settings. We may add, change, or remove features.
Minab is not emergency services, not a medical service, and not a substitute for the school’s own legal, pastoral, or safeguarding procedures.
3. Accounts and eligibility
Accounts are issued by the school (or by us for platform administration). You must use the credentials assigned to you, keep them confidential, and tell the school or us promptly if you think they are misused.
You must provide accurate information when the school or Minab asks for it. You may not share a student or staff login, impersonate someone else, or access another person’s account.
Student accounts, including accounts for children, may be used only under the school’s rules and with the involvement of the school and, where required, a parent or guardian. The App Store or Google Play listing does not itself create a Minab account.
4. Schools and families
The school is responsible for:
- deciding who may have an account and which role they have;
- entering and keeping student and family records accurate;
- obtaining any consents the school needs under applicable law (including for children, photos, and recordings);
- how teachers and staff use Minab in class;
- informing families about the school’s use of Minab.
Parents and guardians who are given an account may see information about linked children and must not share that access with people who are not authorized by the school.
5. Acceptable use
You agree not to:
- use Minab for anything other than legitimate school purposes;
- harass, bully, threaten, or unlawfully harm others;
- upload or share unlawful, sexual, hateful, or otherwise inappropriate content, especially involving minors;
- record, photograph, or redistribute a live class except as the school expressly allows;
- try to break, probe, or overload the Service, or bypass security or role limits;
- copy, resell, or reverse engineer Minab except as the law allows;
- use Minab to send spam or to collect personal data for a purpose unrelated to the school.
We may remove content or suspend access if we reasonably believe these rules are broken.
6. Content you submit
Homework, messages, photos, exam answers, live-class speech, and other material you or the school put into Minab remain subject to the school’s policies and applicable law. You grant us a limited licence to host, store, process, display, and transmit that material solely to operate Minab for the school.
You represent that you have the right to submit that material. We are not obliged to monitor all content, but we may do so to operate, secure, or legally protect the Service.
7. Live classes and recordings
If you join a live class, your camera and microphone may capture audio and video and send them to other participants in that class. The school may enable a recording. Recordings are typically kept only for a short period for students who missed the session, then deleted, unless the school’s configuration or the law requires otherwise.
Do not share live-class links, recordings, or classroom chat outside the people the school intended.
8. Our intellectual property
Minab, including its software, design, name, and trademarks, is owned by us or our licensors. Official textbooks or other third-party materials made available in the library remain the property of their rights holders. You receive a limited, non-exclusive, revocable right to use Minab only as permitted by the school and these Terms.
9. App Store and Google Play
If you download Minab from Apple’s App Store, Apple is not a party to these Terms and is not responsible for the app or its content. Apple’s usage rules still apply. Apple and Apple’s subsidiaries are third-party beneficiaries of this section and may enforce it. The same idea applies to Google Play: Google is not a party to these Terms and is not responsible for Minab.
In-app purchases, if any are offered later, will be charged through the relevant store and subject to that store’s billing rules. Minab as of the date above is a school-provisioned service; school billing, if any, is between the school and us.
10. Availability
We aim to keep Minab available, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, and third-party networks, SMS, or live-video providers may fail. To the extent allowed by law, the Service is provided “as is”.
11. Disclaimer
To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Minab will meet every pedagogical, legal, or record-keeping need of the school.
12. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost grades, lost files, or lost profits, even if we were told they were possible.
Our total liability arising out of Minab is limited to the fees the applicable school paid us for Minab in the twelve (12) months before the claim, or, if none, to a maximum of ten million Iranian rials. Nothing in these Terms limits liability that cannot be limited under applicable law (for example liability for fraud or for death or personal injury caused by negligence, where that cannot be excluded).
13. Suspension and termination
The school may deactivate accounts. We may suspend or end access if these Terms are broken, if fees are unpaid, if we are required to by law, or if we discontinue Minab. After termination, the licence to use Minab ends. Sections that should survive (including intellectual property, disclaimer, liability, and governing law) survive.
How to request deletion of an account is described in the Privacy Policy.
14. Governing law
These Terms are governed by the laws of the Islamic Republic of Iran, without regard to conflict-of-law rules. Courts in Iran have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction to protect our intellectual property or the security of the Service.
If a part of these Terms is unenforceable, the rest remains in effect. We may update these Terms; the current version will be posted at minab.app/en/terms and minab.app/fa/terms. Continued use after an update means you accept the new Terms, except where the law requires a different process for the school.
